The decision by a Cody jury to award a Thermopolis man $1.2 million for a botched spinal surgery shows the need for this state to have a serious discussion about medical malpractice costs.

The state's constitution forbids the Legislature from imposing caps on non-medical damages. That means it is a waste of time for lawmakers to debate the issue. Voters must approve a constitutional amendment lifting that prohibition before such a discussion on caps - - pro or con -- makes any sense.
